1. The Automated AIS Cross-Verification Mechanism

When an employee claims HRA exceeding ₹1,00,000 annually, their employer reports the Landlord's PAN in Form 24Q (Annexure II). The computerized system at CPC Bengaluru immediately matches that PAN with the landlord's Income Tax Return under Schedule HP (Income from House Property).

The Disallowance Red Flag: If the landlord does not report the rental income, or reports an amount lower than what the employee claimed, an automated discrepancy is flagged under the e-Campaign compliance portal.

2. Statutory Penalties: Section 270A & Interest

Statutory Provision Type of Charge Impact
Section 143(1) / 147 Principal Tax Demand Full tax on disallowed rent at 30% slab + 4% cess
Section 270A(8)/(9) Misreporting Penalty 200% of the tax payable on misreported income
Section 234A/B/C Interest on Default 1% per month simple interest until recovery

3. What to Do If You Received a Notice

If the Tenancy Was Legitimate: Upload your registered/notarized rent agreement, bank statements showing monthly rent debits, and stamped receipts via the e-filing portal.

If Inaccurate Receipts Were Claimed: File an Updated Return (ITR-U) under Section 139(8A) to declare the additional income and pay differential tax, avoiding Section 270A criminal misreporting penalties.
